George Zimmerman waives Stand Your Ground hearing

SANFORD -- George Zimmerman is at the Seminole County Courthouse this morning for the latest hearing in his second-degree murder case.

Zimmerman spoke in court for the first time in months. He agreed to waive his rights to a Stand Your ground preliminary hearing.

Under questioning from Circuit Judge Debra Nelson, Zimmerman repeatedly said "yes" to a series of questions asking if he was aware he was giving up the right to a hearing before his second-degree murder trial in June.

Man indicted in toddler's death accused of poking her in the head

KATC has new information about the 19-month-old Eunice toddler who died allegedly at the hands of her mother's boyfriend. According to St. Landry Parish Clerk of Court records, a forensic pathologist ruled Victoria LeJeune died from acute traumatic brain injury. Last week, a grand jury indicted Robert H. Miller III on second degree murder in the toddler's death.

On Feb. 24, when a St. Landry Parish deputy was called to check on an unresponsive Victoria at 564 Hwy. 190 Lot 17 in Eunice, he noticed "numerous bruises on the infant's face and body," court records state. Victoria was pronounced dead at Acadian Medical Center.

The family who now lives in the home where Jodi Arias stabbed her ex-boyfriend Travis Alexander to death are now treated to a constant stream of unwanted visitors who drive past the home because of their morbid fascination about the case.

Alexander's home was sold in foreclosure in 2009, the year after he was stabbed nearly 30 times and shot by Arias.

'I was a little nervous about it. My husband, though, it didn't bother him. He said, "This is a good deal. It's a beautiful home. It's in a great school district,"' the homeowner told USA Today.

SHEBOYGAN — A 16 year old Sheboygan girl that went missing over a week ago has been located Tuesday afternoon.

According to the Sheboygan Police Department, no suspicious circumstances were reported.

Family and friends were looking for Keyona Marie Olden. She was at home watching television on the evening of Friday, April 19 with her mother and went to bed at 9:30 PM. When her mother checked on her around 1 AM, she was no longer in her bedroom.

NEWARK, N.J. (CBSNewYork) -- A New Jersey Army major and his wife have been arrested on child endangerment charges stemming from a 17-count indictment.

John and Carolyn Jackson were detained Tuesday pending a bail hearing.

The Mount Holly couple is charged with one count of conspiracy to endanger the welfare of a child, 13 counts of endangering the welfare of a child and three counts of assault, authorities said.

The two are accused of denying their children food, water and medical care and physically abusing them, including breaking bones and force-feeding them hot sauce, U.S. Attorney Paul Fishman said.

Police: Remains not those of missing Conn. girls

VERNON, Conn. (AP) — Vernon police say DNA tests show that human remains found in a wooded area in March are not those of three girls who disappeared in the late 1960s and early 1970s.

Police announced the test results Tuesday. Authorities say they still don't know the person's identity and a DNA sample entered into a national database came back negative for a match.

The testing ruled out any links to the cases of Lisa White, Janice Pockett and Debra Spickler.

Jury of twelve to sit on the April Jones trial

Today a jury of 12 will be selected from a potential panel of 30 to sit on the April Jones trial.

All were asked yesterday to ensure they had no connections to the Machynlleth area where the five-year-old went missing, or any links to up to 60 witnesses, who will give evidence.

Tomorrow marks seven months to the day that April went missing, prompting one of the biggest police searches in UK history.

That search was called off just last week.

On Thursday the jury will visit various sites in Machynlleth.

Bennett gets new attorney

Accused child killer Anthony Michael Bennett is scheduled to be in federal court next week for a status conference after getting a new attorney.

Ann Arbor attorney John A. Shea was appointed to represent Bennett, accused of the June 21 murder of 4-year-old Carnel Chamberlain, following former defense attorney Anthony Chambers disqualifying himself because he was suspended from practicing law in Michigan April 22.

Chambers was suspended by the State Of Michigan Attorney Discipline Board for misappropriating client fees and other ethical violations.

Man accused of complicity in double-murder appears in court

RICHMOND — In a brief pretrial hearing Tuesday morning, a man accused of complicity in the murder of a Madison County couple appeared before Judge Jean C. Logue.

Lebruce Ellington, 33, pleaded not guilty in January to complicity to murder, kidnapping and tampering with physical evidence in the 2010 deaths of Sonsaray Warford and Charles Walker.

The couple’s bodies were found in March 2012 in shallow graves off Tates Creek Road.

“This is a sad time in Calaveras County,” the sheriff said at news conference outside of the Valley Springs sheriff’s substation before a battery of TV cameras, microphones and reporters. “ … We are doing everything possible to apprehend the person responsible for the murder of this 8-year-old girl.

The mystery “forest boy” who duped Berlin police and social workers into believing that he was an abandoned child who had roamed the woods of central Europe for five years has revealed that rent arrears and a pregnant ex-girlfriend drove him to launch his elaborate hoax.

Robin van Helsum, a Dutch citizen who is now 21, turned up at Berlin’s town hall in September 2011 sporting a pageboy haircut and T-shirt and equipped with a rucksack, sleeping bag and a two-man tent. Speaking in English, his first words to officials were: “I am all alone in the world.”

April went missing near her home in Machynlleth, Powys on 1 October 2012.

Mark Bridger, 47, from Ceinws near Machynlleth, denies abducting and murdering April, and intending to pervert the course of justice.

The court heard juvenile bone fragments were found at Mr Bridger's home.

Soil, calls link man to site where slain Fayetteville girl dumped

FAYETTEVILLE, N.C. — Prosecutors told jurors Monday that they can link a man accused of raping and killing a 5-year-old Fayetteville girl in 2009 with the location where her body was found.

Mario Andrette McNeill, 32, is charged with murder, rape and kidnapping in the death of Shaniya Davis. He could face the death penalty if convicted of murder.

Shaniya's body was found in a kudzu patch off N.C. Highway 87 near the Lee-Harnett county line on Nov. 16, 2009, six days after her mother, Antoinette Nicole Davis, reported her missing from their mobile home on Sleepy Hollow Drive in Fayetteville.

McNeill was seen with the girl on a Sanford hotel security camera hours after her disappearance, and Cumberland County District Attorney Billy West said in his opening statement that investigators found cocaine and some of McNeill's pubic hair in the room.

A Baltimore judge sentenced Policarpio Espinoza Perez to life in prison Monday for conspiring to murder his brother's two children and their young cousin nearly a decade ago in a killing described as the "most horrific" to ever come before the court.

The parents of Ricardo and Lucero Espinoza, 8 and 9 years old, came home to their Fallstaff apartment in May 2004 to find the boys and their 10-year-old cousin, Alexis Espejo Quezada, beaten and mutilated, their throats cut and bleeding.

The images haunt the children's survivors today, members of the large Mexican immigrant family told the court Monday. They said the punishment brings no solace.

Peterson attorney accepts 3-month law license suspension to settle disciplinary charges

One of Drew Peterson's attorneys has agreed to have his law license suspended for three months to settle state disciplinary charges alleging he stole another client's money, records show.

David Peilet, who joined Peterson's defense team last fall to assist with the post-trial appeal after the former Bolingbrook police sergeant was found guilty of drowning his third wife, was accused last April of pocketing almost $4,000 in client money from a 2010 drug case.

Peilet said in court papers that he was suffering from alcohol addiction at the time of the theft but has since undergone treatment and stopped drinking. He has agreed to two years of disciplinary probation along with a two-year suspension of his law license with all but three months stayed, records show.

Jodi Arias has been on trial for the murder of her ex-boyfriend Travis Alexander. The young woman shot her estranged lover in the face, stabbed him 27 times, and slit his throat and now could be facing the death penalty if found guilty.

During her time in prison, Arias has been drawing pictures and sketches of people and asking fans to buy them so she would have enough money for her court and lawyer fees. One of her controversial "original artwork" of what Arias titled "The Hat Series" which resembled Travis' sister, Tanisha Sorensen who has been present during the trial, however, now new revelations show that the art work are pure imitations of print advertisements.

The jurors will be taken to Machynlleth in mid-Wales seven months after April went missing as she played out on her bicycle.

U.D. man accused of beating child sought

MEDIA COURTHOUSE — An Upper Darby man accused of assaulting his 6-week-old infant is being sought by police after failing to appear for a hearing Monday.

Damon Gary, 36, of the first block of South Keystone Avenue, was allegedly baby-sitting the child in mid-December while the boy’s mother returned to work.

When she came home, the mother allegedly saw the child’s lips were swollen, his left eye was bloody and he had bruises on his cheek.

Theater rampage: Holmes' lawyers object to Colorado insanity law

CENTENNIAL, Colo. – Defense attorneys for accused movie theater gunman James E. Holmes renewed their objections Monday to the constitutionality of the state’s insanity defense, giving another hint about how they hope to save their client’s life.

Holmes is accused of opening fire in a packed Aurora theater on July 20, killing 12 people and wounding 70 others. He is charged with 166 counts of first-degree murder, attempted murder and weapons charges.

Dist. Atty. George Brauchler announced April 1 that his office would seek the death penalty.

But Homes cannot be put to death if he is found not guilty by reason of insanity or mental defect.

Jodi Arias: Trial continues soon; Arias' friend Daniel Freeman speaks out

PHOENIX - A mutual friend of accused murderer Jodi Arias and victim Travis Alexander is speaking out for the first time since he testified for the defense in January.

Daniel Freeman was the friend caught in the middle. He was closer to Alexander, but so charmed by Arias he considered her part of his family.

“She was like a sister. She was part of the family and in my family when you’re a friend you’re family,” said Freeman of his once close relationship to Arias.

Grandmother of abused girl pleads guilty to charge

The grandmother of a 10-year-old Arizona girl who authorities say died after another relative padlocked her in a footlocker has pleaded guilty to attempted child abuse.

Seventy-four-year-old Judith Deal wasn't charged in Ame Deal's death in July 2011, but was accused of putting hot sauce on the child's mouth, hitting her with a paddle and putting her inside the footlocker as a form of discipline.

She pleaded guilty Friday to two counts of attempted child abuse and faces a punishment ranging from probation to 30 years in prison.

Sentencing is set for June 4.

Attorneys in the case of a 2-year-old girl’s death painted different pictures Monday of the man and woman who are now standing trial in Floyd County Superior Court.

Eric Castro, 28, and Heather Brittany Parker, 22, each face charges of murder, aggravated assault, aggravated battery and child cruelty in connection with the June 25, 2012, death of Parker’s daughter, Kailee Marie Parker, court records state.

Lia Green’s mum faces new charge

Lia Green’s mum has been cleared of causing or allowing the toddler’s death - but now faces a lesser charge of child cruelty.

Three-year-old Lia was pronounced dead at Royal Preston Hospital on August 30 last year, after falling ill at her home in Norris Street, Plungington, Preston.

The toddler’s dad Richard Green, 23, of Harling Street, Ribbleton, Preston, denied her murder, but after 10 days of a trial at Preston’s Sessions House, pleaded guilty to manslaughter.

No fewer than eight motions and demands are slated to be heard by Judge Debra Nelson Tuesday, as George Zimmerman returns to the courtroom where his murder trial is set to begin in six weeks.

But it’s the one item not yet officially on the docket that could prove most interesting.

Prosecutors want Judge Nelson to “conduct a full inquiry” of Zimmerman to make sure he understands he is waiving his right to a pretrial immunity hearing.

At least, it appears he is waiving that right.

A hearing has been set in Casey Anthony's Chapter 7 bankruptcy case next month, when two people suing the infamous former murder defendant for defamation will continue their fight to salvage their lawsuits.
The suits, brought separately by Zenaida Gonzalez and Roy Kronk, were put in jeopardy by Anthony's January bankruptcy filing, which seeks the discharge of all of her debts and any other claims against her.

Mark Bridger has appeared at court at the start of his trial over the murder and abduction of April Jones.

Appearing at Mold Crown Court this morning dressed in a blue shirt and tie, the 47-year-old spoke to confirm his name.

The jury for the trial is due to be sworn in today, with the opening of the case expected to take place later in the week.

The missing five-year-old's parents Coral and Paul Jones also arrived at Mold Crown Court this morning.

Durham, N.C. — Twelve jurors were seated as of Wednesday afternoon in the trial of a man accused of killing his wife in their Durham home eight years ago.

 Raven Abaroa, 33, is charged with first-degree murder in the April 26, 2005, stabbing death of 25-year-old Janet Abaroa. He has maintained that he was at a soccer game in Morrisville when his wife was killed and returned home to find her on the floor and their 6-month-old son unharmed in another room.

Barbara Parchem disappearance called 'foul play' by Sheriff's Office

St. Johns County homicide detectives believe that a Vermont Heights woman, Barbara Parchem, 67, missing since April 5, has met with foul play, Sheriff David Shoar said Friday afternoon.

Clutter's wife, Jaime, 35, and their two children Brandon, 10, and Katelyn, 6 months, were found naked and floating in a creek at Binford Park in New Albany in March. Authorities believe the two children drowned. The cause of death for Jaime Clutter has not been determined. Toxicology reports were ready but had not been delivered to New Albany Police, Chief Sherri Knight said.

The lead detective in the Phylicia Barnes murder investigation was criminally charged by city prosecutors Monday in connection with a 2012 search for his own missing daughter.

The charges come four weeks before the murder trial is scheduled to go before a jury for the second time.

Det. Daniel T. Nicholson IV was charged with two counts of second-degree assault, one count of fourth-degree burglary and one count of making a false statement to police, prosecutors announced. The charges were filed more than a year after Nicholson allegedly forced his way into a Northeast Baltimore apartments in a frantic search for his daughter, who had run away from home.

(Reuters) - Prosecutors in Florida want George Zimmerman to state publicly at a court hearing on Tuesday whether he will pursue his immunity defense in the 2012 shooting death of teenager Trayvon Martin on the basis of the state's "Stand Your Ground" law, or waive his right to use it.

Prosecutors asked Judge Debra Nelson in a motion to remind Zimmerman "that should defendant in fact wish to waive any pre-trial immunity challenge under this statute, he may not attempt to do so later, particularly once trial has commenced."

UPDATE: FOUND SAFE - Amber Alert issued for NM 6-year-old

A boy who may have been abducted at gunpoint from his home in Roswell was found safe in Lubbock hours later, according to New Mexico State Police.

Authorities in New Mexico issued an Amber Alert for six-year-old Elijah Reczek. They say his mother, who lives in Montana, took the boy from his home around Midnight early Monday. Lubbock Police stopped a van with the boy and other people inside around 10:45 Monday morning.

Elijah is three foot six inches tall, weights about 45 pounds, has hazel eyes and shot brown hair. Also Elijah has a small mole on his left cheek

He was last seen about midnight Monday morning at 2711 South Emrald in Roswell.

His mother, Miranda Ann Aguilar, 30, who lives in Montana, took the boy at gunpoint

Aguilar, a Native American woman, stands five foot four inches tall, weighs 115 pounds with long black hair.

The 25-year-old American, who is facing renewed accusations that she was involved in the killing, reveals in her book, Waiting to be Heard, that she was eventually dissuaded from sending the letter by her legal team.

In extracts from the book, which will be published in the US on Tuesday, Knox wrote that she wrote letters to both the Kerchers and to Patrick Luamba, the Congolese barman she falsely accused of the murder.

Police say the body of 42-year-old Eric Merz of McKinney was located Sunday afternoon at the base of a highway exchange in Allen. Police say the preliminary investigation indicates Merz took his own life.

Mario McNeill trial to get underway today in Shaniya Davis murder

FAYETTEVILLE, N.C. -- The trial of the man charged with raping and killing a 5-year-old Fayetteville girl in 2009 is scheduled to start this week after a judge ruled the man is mentally competent to stand trial.

Jurors are expected to hear opening statements when the trial of Mario McNeill begins Monday in Cumberland County court. McNeill is charged with raping and killing Shaniya Davis in November 2009.

Last week, Superior Court Judge Jim Ammons ruled that the 32-year-old McNeill is competent to stand trial.

Ammons is expected to rule Monday on a motion by McNeill's lawyers to prevent prosecutors from telling the jury that McNeill knew where Shaniya's body had been hidden.

HALLANDALE BEACH (CBS4) – Cell phones are the latest piece of evidence Hallandale Beach Police detectives are looking at to unravel the murder of baby Dontrell Melvin.

CBS4 News has obtained court documents that show detectives are searching through several cell phones possibly belonging to the child’s mother – Brittney Sierra. A search warrant reveals that investigators are looking for photos, texts or Facebook conversations that might show the last time the baby was seen alive. The search warrant shows that police retrieved several cell phones and an external hard drive from the home of Sierra’s mother earlier this month.

Twenty-six-year-old Lindsey Lowe gave birth to her twins in a suburb of Nashville, not in a hospital, but in her parents' home and without help.

A small crowd soon turned into a few dozen at a remembrance vigil for Brittanee Drexel, the Gates Chili High School student who vanished four years ago.

Brittanee, then 17, went missing April 25, 2009. The vigil was held at Ontario Beach Park in Charlotte on Thursday to commerate the anniversary of her disappearance. Brittanee was last seen leaving a Myrtle Beach hotel on a spring break trip with friends.

The silent crowd that gathered Thursday included Drexel’s dad, grandmother, sister and friends. Brittanee’s mom, Dawn Drexel,was in Myrtle Beach, where she also held a remembrance ceremony.

More than a year since Brittany Dawn Killgore’s body was found just outside of San Diego County, a prosecutor in the murder case is sorting through new evidence.

Three weeks ago, a judge allowed prosecutor Patrick Espinoza access to a “pile” of handwritten documents reportedly created by one of the defendants. A friend of defendant Dorothy Maraglino gave the papers to her defense attorney, according to statements in court.

Dorothy Maraglino, 37, and Jessica Lopez, 25, and Louis Ray Perez, 46, are all charged with kidnap and torture and murder in the death of Brittany Killgore, who was 22-years-old when she disappeared.

"I've never been through anything this horrible in my life." A heartbroken father describes what it's like to lose his one and only child.

The community continues to support Skylar Neese's family. Sunday, they held a benefit spaghetti dinner at the Ramada Inn in Morgantown.
Sixteen-year-old Skylar Neese went missing from her Morgantown home in July of last year. She was seen on a surveillance video getting into a car that night, after sneaking out of her window.

The video lead to no clues to her whereabouts. But Skylar's remains were found months later in Pennsylvania.

With no explanation as to why, her family is left to pick up the pieces and go on.

Edmonton woman who drowned her sons mulls having babies

An Edmonton-area mother who was deported after drowning her two sons has told an Aussie newspaper that she is considering having babies again.

“I wouldn’t say no,” quoted Allyson McConnell in the Australian-based newspaper “The Australian.”

McConnell, who is in her home-country of Australia, gave that answer when asked if she would like more children in the future.

McConnell pleaded guilty to drowning her two-year and 10-month sons in their bathtub in 2010.

The father of one of the Evansdale cousins abducted and killed will not go on trial Monday.

Lyric Cook’s father, Dan Morrissey, was scheduled to go on trial Monday on charges of assault against his wife, Misty Morrissey.

Court officials told the Waterloo-Cedar Falls Courier that a witness schedule issues forced the delay of trial and a new date is not yet set.

CALAVERAS COUNTY -- The Calaveras County Sheriff's Department continued its massive hunt Sunday for a man suspected of fatally stabbing an 8-year-old girl at her Rancho Calaveras home over the weekend.

The department identified the girl as Leila Fowler, a third-grader at Jenny Lind Elementary School in Valley Springs, a few miles north of Rancho Calaveras.

Friends described Leila as a child with a smile that would melt anyone's heart and a winning personality, and as a daddy's girl who loved the color purple.

Social media has played large role in Trayvon Martin case

SANFORD, Fla., April 28 (UPI) -- Lawyers in the Trayvon Martin case can agree on one thing: The uprising on social media from across the United States has dramatically influenced the case.

Mark O'Mara, who is representing George Zimmerman, the Sanford, Fla., neighborhood watch captain who admits to killing Martin, said social media pressure is what led to his client's indictment.

"I think if I could do away with all media, including all social media, I would not have an involvement in a criminal case," O'Mara said. "But that's a fantasy that was 40 years ago."

Trial in central Illinois family's brutal killings to start

PEORIA, Illinois — The trial for the first of two brothers charged in the brutal killings of a central Illinois family is slated to begin later in the day.

It's been more than three year since five family members were found dead in their Beason home.

Christopher Harris and his brother, Jason Harris, have pleaded not guilty to murder in the September 2009 beating deaths of 46-year-old Raymond Gee, his 39-year-old wife, Ruth Gee, 16-year-old Justina Constant, 14-year-old Dillen Constant and 11-year-old Austin Gee. Three-year-old Tabitha Gee survived.

Girl, 17, missing for 4 months from Las Cruces

LAS CRUCES -- Wendi Williamson-Cox of Las Cruces hasn't seen her teenage daughter since December.
But, for Williamson-Cox, it seems longer.

For a while, well before 17-year-old Brandi Williamson ran away, her mother didn't recognize her.
Williamson stopped being the respectful, straight-A student at Oñate High her mother knew. She started skipping school, and hanging out with an older woman.

"I'm scared to death of where she is," Williamson-Cox said.

The piece of information most closely resembling a clue Williamson-Cox has received suggested her daughter had gone to Las Vegas.

But that unsubstantiated information came in January, with no update since then.

Trial to start in case of NC girl killed in 2009

FAYETTEVILLE, N.C. (AP) — The trial of the man charged with raping and killing a 5-year-old Fayetteville girl in 2009 is scheduled to start this week after a judge ruled the man is mentally competent to stand trial.

Jurors are expected to hear opening statements when the trial of Mario McNeill begins Monday in Cumberland County court. McNeill is charged with raping and killing Shaniya Davis in November 2009.

Peru State responds to suit over missing student Tyler "Ty" Thomas

A federal judge has been asked by Peru State College and state college officials to dismiss a lawsuit filed by the mother of a missing Peru student that alleges the school failed to protect her from a fellow student.

Tyler "Ty" Thomas was a 19-year-old college freshman when she went missing from campus Dec. 3, 2010.

Her body hasn't been found, but her family believes she was killed that day, the victim of an assault and an abduction.

Joshua Keadle, who is thought to have been the last one to see Thomas alive, has been described as a person of interest in the case.
