Judge tosses neglect case on mother of Jada Justice

Susan Brown
CROWN POINT | Lake Criminal Court Judge Thomas Stefaniak Jr. issued a directed verdict Thursday, clearing Melissa Swiontek of a neglect charge in the death of her 2-year-old daughter.

Stefaniak said testimony showed Swiontek did not have knowledge of heroin use by her cousin, Engelica Castillo and Castillo's boyfriend, Timothy Tkachik. Swiontek had left her daughter, Jada Justice, with the couple.

However, Stefaniak emphasized "it is never a good idea" to place children for safekeeping with drug-addicted people.

Castillo, then 18, and Tkachik, then 23, beat Jada Justice to death in June 2009, later burning and encasing the girl's body in concrete and thrown into a region swamp.

NOPD will consult with DA’s Office about accidental shooting death of 5-year-old girl

New Orleans bureau
June 27, 2013
She was gone for 10 minutes, she told the police. Long enough to walk to the end of the block, talk to some neighbors and return home.

She locked her 5-year-old daughter alone in the house, with the .38-caliber revolver that was often kept underneath a bed pillow.

The next-door neighbor heard the shot.

Brandajah Smith had apparently taken the gun into a closet Sunday morning, and shot herself through the forehead, according to court documents.

She was a smart little girl, who talked to grown-ups with remarkable ease, her relatives said. She loved SpongeBob Squarepants and practicing her ABCs. She was a mama’s girl, they said. Her family called her an old soul, nicknamed “lil bitt” or “DayDay.”

Insanity defense ruling coming in Tenant homicide case

June 27, 2013
By Rick Pfeiffer
Niagara Gazette — LOCKPORT — Niagara County Court Judge Matthew J. Murphy III will rule on Wednesday on whether the defense in the Isabella Tennant murder case will be able to use a so-called "insanity defense."

Prosecutors argued Wednesday that the lawyer for John Freeman Jr. should be barred from presenting the defense to a jury because he hasn't specifically indicated what mental illness his client suffers from.

"(The motion for an insanity defense) fails to identify a specific psychiatric (illness)," Assistant District Attorney Holly Sloma argued.

Sloma said reports, submitted by experts who have examined Freeman, have suggest between six and eight possible psychiatric disorders that he may have.

Court hears Kiesha's mother abused as child

June 28, 2013
Paul Bibby
Court Reporter
The Sydney mother who murdered her six-year-old daughter after repeated acts of violence that were known to community services was herself abused as a child and failed by the system, a court has heard.

''It's easy to hate Kristi Abrahams,'' her barrister Janet Manuell, SC, told the NSW Supreme Court during the final day of the 30-year-old's sentencing hearing for the murder of Kiesha Weippeart.

''It's very confronting for a community to accept the death of a child at the hands of a mother. But Kristi Abrahams is very much a product of what happened to her. She didn't receive the care she needed and that was a failure of the system.''

James Holmes to be harnessed to courtroom floor

AP/ June 27, 2013, 9:33 PM
DENVER Colorado theater shooting suspect James Holmes will be restrained during his trial by wearing a harness under his clothes that will be anchored to the floor, the judge said Thursday.

Judge Carlos A. Samour Jr. also ruled the jury will not be sequestered during the trial, which is scheduled to start in February and is expected to take four months.

Holmes is accused of killing 12 people and injuring 70 others at a movie theater in the Denver suburb of Aurora in July.

He has worn heavy shackles on his wrists and ankles during pretrial hearings. His lawyers wanted him to be unshackled during the trial, saying the restraints would make him look guilty to the jury.

Florida DCF faces questions over 2-year-old Ezra Raphael

4:30 PM, Jun 26, 2013
Dave Heller
Tallahassee, Florida - The Florida Department of Children and Families is facing questions over the way it handled the case of a 2-year-old boy allegedly killed by his mother's boyfriend.

The Miami Herald reports Ezra Raphael suffered trauma to his back and neck and was unresponsive when paramedics arrived at his home in North Miami Beach last week.

The medical examiner has ruled the death a homicide. The suspect is in jail on a charge of first-degree murder.

The report says DCF investigated Ezra's mother, 22-year-old Cierrah Raphael, earlier this year when she left her son with a stranger in Gainesville and said she could not take care of him any longer.

That’s the story 32-year-old Alexis told North Miami Beach Police detectives Monday when he reportedly confessed to killing Ezra Raphael, his girlfriend’s son. Alexis had been left alone with the boy late on the night of June 21, the couple told police, so that 22-year-old Cierrah Raphael, a prostitute, could turn tricks.

Sarah Murnaghan suffers setback, still on breathing tube after transplant

Published: Thursday, June 27, 2013
PHILADELPHIA (AP) — The mother of a 10-year-old Delaware County girl recovering after a double lung transplant says doctors tried to remove her breathing tube but were forced to reinsert it.

Janet Murnaghan, of Newtown Square, said in a statement provided by a spokeswoman that her daughter, Sarah, "could not handle the reduced support" after the tube was removed Wednesday. She called the day "excruciating" and said it was "impossibly painful" watching her daughter struggle to breathe, so the girl was ultimately sedated and re-intubated.

Three years after Texas woman’s suicide, a question lingers: Who was she?

By Cristina Corbin
Published June 26, 2013
To her husband, she was Lori Kennedy. But to a dogged federal investigator, she is "Jane Doe," a Texas mother who killed herself three years ago in her family's driveway after spending decades using stolen identities to erase a past that remains mired in mystery.

For two years, Social Security investigator Joseph Velling has been working to uncover the real identity of Lori Erica Ruff, who was Lori Erica Kennedy before marrying into an East Texas family in 2004. Prior to that, she was known as Becky Sue Turner, an identity forged with the birth certificate of a long-dead child. Velling, a seasoned government sleuth, has been stumped in figuring out the true name and background of this Jane Doe, who took on aliases with spy-like sophistication.

Is 'Witness 8' hurting the state in George Zimmerman trial?

Thursday, June 27, 2013, 9:46 AM
One of the prosecution's most important witnesses in the Trayvon Martin murder case is 19-year-old Rachel Jeantel. Following her testimony on Wednesday, legal analyst Vanessa Braeley said she could actually be hurting the state's case.

Braeley said the state could have avoided the possibly damaging testimony.

"You're not supposed to coach your witnesses as an attorney, but you certainly want to speak with them and get a temperature read on how they're going to respond in court," she said. "If I were the state, I would've limited the questioning to only and specifically what they wanted her to say and move on."

The judge in the Aurora theater shooting case is prepared to summon the largest jury pool ever called in Colorado if the case goes to trial.

The 5,000 summonses that Judge Carlos Samour said this week he intends to send out to prospective jurors would dwarf other jury pools summoned in Colorado and would be at least among the largest called in U.S. history, according to a national expert on jury selection.

People on the jury rolls in Arapahoe County, where the trial is scheduled to start in February, would have a roughly 1-in-90 chance of being summoned for the trial.

A missing blue, double-tandem stroller that was put into a sex offender’s van before 8-year-old Cherish Perrywinkle was abducted and killed is the latest development the Jacksonville Sheriff’s Office called a priority Wednesday.

Although police have already arrested 56-year-old Donald James Smith, Chief of Investigations Annie Smith asked the public to be on the lookout for the Perrywinkles’ stroller. It was last seen being put into the back of the suspect’s van Friday night at the Dollar General on Edgewood Avenue West.

Police released a photo of a stroller similar to one seen being pushed at the Dollar General but also said the real stroller was older and more beat up.

Jodi Arias attorneys seek to vacate death eligibility

Published June 26, 2013
Associated Press
PHOENIX – Jodi Arias' attorneys have asked a judge to vacate the jury's decision in her murder trial that the 2008 killing of her boyfriend was "especially cruel," a finding that allowed the panel to consider the death penalty.

Defense attorneys argue in their motion that the definition of "especially cruel" is too vague for jurors with no legal experience to determine what makes one killing more cruel or heinous than another.

The filing also appears to challenge a landmark 2002 U.S. Supreme Court ruling that found a defendant has the right to have a jury, rather than a judge, decide on the existence of an aggravating factor that makes the defendant eligible for capital punishment.
