DHHS caseworker blames baby's death on suspect's mother's 'neglect'

DHHS spelled out that allegation in a "Notice of Substantiation or Indication and Your Right to Appeal," dated Aug. 10, that was sent to Amanda Huard, 30, of Center Road in Fairfield.

 Maine State Police have charged Huard's 10-year-old daughter with manslaughter in the July 8 death of Brooklyn Foss-Greenaway of Clinton, after an incident at Huard's home.

The mother of a 3-month-old girl who police say was killed by her baby sitter's 10-year-old daughter is demanding more charges.

 Earlier this week, investigators announced the death of Brooklyn Foss-Greenaway in July was a homicide.

 Police said the infant died while being watched by Amanda Huard.

Murder warrant issued for man in ex-girlfriend's death

The Orange County Sheriff's Office issued a first-degree murder warrant for the man accused of killing his ex-girlfriend.

Officials issued the warrant for 33-year-old Kris Gould who was the only person of interest in the death of Jorgete Acarie.

Acarie, 43, was found dead in her Forrest Run lane home near Dr. Phillips on Sunday. Her 2-year-old son with Gould was in the house when his mother was shot multiple times, authorities said.

Acarie's sister Viviane Acarie said the boy watched his mother being shot to death.

Viviane Acarie said in a childlike way he described to the family what happened and who did it.

Police work to identify victim after a woman's torso found in Niagara River

NIAGARA FALLS, Ont. - Police in Ontario have determined the torso recovered from the lower Niagara River belongs to a Caucasian woman between 20 and 40 years old.

Police say the preliminary post-mortem indicates the woman had a pierced navel and at least one caesarean section scar.

W.Va. man gets 40 years for sniper-style slaying

CHARLESTON, W.Va. (AP) — A man convicted of one of three sniper-style slayings that rattled the Kanawha Valley in 2003 was sentenced Friday to the maximum 40 years in prison.

Kanawha County Circuit Court Judge Duke Bloom also said Shawn Lester, 37, of Charleston will not get credit for time served since his arrest, media outlets reported.

Lester pleaded guilty on July 30 to second-degree murder in the fatal shooting of Jeanne Patton. In exchange for the plea, first-degree murder charges were dropped in the deaths of Patton, Okey Meadows Jr. and Gary Carrier Jr.

INDIANA, Pa. -- A district attorney says he'll pursue the death penalty against a western Pennsylvania man awaiting trial on charges that he killed his two young daughters and his estranged wife.

Indiana County District Attorney Patrick Dougherty (DAWK'-er-tee) says he's "never been involved in a more horrible case" than the prosecution of 41-year-old Lewis Beatty, of Home.

Beatty's attorney, Fred Hummel, says he anticipated the decision but otherwise declined comment.

Zinah Jennings delivers second child; trial delayed

'Grim Sleeper' serial killer case ballistic evidence to be reviewed by defense

It looks like court proceedings for Lonnie Franklin, the man accused of being the South Los Angeles "Grim Sleeper" serial killer, will be slow. In what was sure to be one of many pretrial hearings Thursday, defense attorneys reported they're hiring an independent analyst to look at ballistic evidence in the case.

Deputy District Attorney Beth Silverman expressed slight frustration with the delays.

"We took this to the grand jury to avoid a lenghty pretrial and cut down on it dragging out," she said. "But I know this is a capital case, and the defense wants to avoid issues of not being prepared."

The defendant appeared relaxed as he sat with attorneys in an orange jail jumpsuit at the high security courtroom in downtown L.A. Franklin is accused of murdering seven women between 1985 and 1988 and an additional three women between 2002 and 2007. The apparent 14-year hiatus between the murder sprees prompted the name "Grim Sleeper." Franklin was arrested in July 2010 and was accused of the murders.

Canine evidence allowed in court

Detroit — A canine expert, whose dog allegedly detected a cadaver scent in the home and car of a father charged in the killing of his missing 2-year-old daughter, will be allowed to testify at trial, a judge ruled Friday.

Wayne County Circuit Judge Vonda Evans said the testimony will be admitted in D'Andre Lane's Sept. 18 trial. The Detroit father is charged with first-degree murder and child abuse in the death of Bianca Jones.

Evans delivered her decision after Lane's defense team spent more than two hours trying to discredit the relatively new scientific method of using cadaver dogs to detect human decomposition.

SMITH COUNTY — UPDATE: According to Justice of the Peace Precinct 4 Judge Mitch Shamburger, 2-year-old Jake Kimbley's autopsy is still pending.

Judge Shamburger tells KETK the results could take up to another month before they are conclusive.

The death of 2-year-old Jake Kimbley has rocked the East Texas community, leaving many searching for answers as to how it happened.

The child was found dead Wednesday morning in a septic tank near his home. Authorities say Kimbley disappeared while playing hide and seek with two other children, who were unharmed.

They were unable to do this because they are waiting on the State Attorney to respond to a motion from the appellate court.

ST. CLOUD, Fla. -
A man accused of watching teens swim at an Osceola County RV park later tried to kidnap them before getting into a fight with the father of one of the girls, according to deputies.

Randall Martin, 46, of St. Cloud, was arrested Thursday night on charges of attempted kidnapping and aggravated assault.

According to the Osceola County Sheriff's Office, deputies were called around 8:40 p.m. to 5150 Boggy Creek Road in St. Cloud and two females, ages 15 and 19, said a man whom they didn't know, later identified as Martin, was watching them swim at a RV park's community pool.

TYLER,TX — The parents of Jacob Kimbley parents David and Sabrina Kimbley have been indicted after the CPS hearing.

The parents headed to court today for a hearing to determine whether the five Kimbley children remain in CPS custody or return to the parents.

Parents of Jacob Kimbley, David and Sabrina Kimbley were each charged with 13 counts of child endangerment/abandonment.

They are currently in the Smith County Jail.

Bail is set at $1.3 million a piece.

Court drops child killer’s life sentence

A Clifton man may walk out of prison in 20 years after the Colorado Court of Appeals on Thursday reversed a 2008 first-degree murder conviction in the death of the man’s toddler stepson.

Brandon Moore, now 27, who had been serving life in prison without the possibility of parole, will be eligible to go before the state’s parole board starting as early as 2032, according to Katherine Sanguinetti, spokeswoman for the Colorado Department of Corrections.

District Attorney Pete Hautzinger said the surviving family of 23-month-old Logan Acord on Thursday made clear to him their wishes for Moore’s case.

“If nothing changes from here on out, this family would strongly want a trial on the first-degree murder charge,” Hautzinger said, signaling he’d do just that. Carolyn Tyler, spokeswoman for Colorado Attorney General John Suthers, said attorneys had no decision on a possible appeal to the Colorado Supreme Court.

More expert testimony is expected Friday as the Christopher Vaughn murder trial wraps up its second week.

Mary Wong, a forensic scientist with the Illinois State Police, said Friday she gunshot residue on Vaughn’s underwear waistband, his jacket and Kimberly Vaughn’s hands after the June 14, 2007, shootings that left Kimberly Vaughn and her three children dead.

Wong, though, said the powder on Kimberly Vaughn’s hands doesn’t mean she shot the gun, but could have been in contact it or near it.

A holidaymaker claims he saw Madeleine McCann on board a flight from Ibiza to Munich.

Tourist Frank Bode contacted British cops after he saw a little girl resembling the missing youngster with a German family on the holiday jet.

The 42-year-old managed to take a blurry photograph of the child, who he said was British and did not seem to fit with her family.

“My intuition told me that the girl, who was around seven to 10 years old, could be Madeleine,” Mr Bode told the Olive Press , an English newspaper published in Spain.

Two 10-year-old girls who sparked a major police search with a prank 999 call will not face criminal charges, the YEP can reveal.

As reported in the YEP, the pair orchestrated the elaborate hoax, posing as a three-year-old girl called Ellie, whose mum had collapsed in the kitchen of her Leeds home.

The call to the ambulance service on July 30 prompted a frantic bid to find the mystery tot.

Police estimate it wasted around £3,000 of taxpayers’ money and tied up more than 12 investigating officers before eventually being traced to a mobile phone in Bridlington.

Mom sets up Facebook sting to prove to daughter her boyfriend is no good

A mother who found out that her 17-year-old daughter was dating a registered sex offender set up a sting on Facebook to show her daughter another side of her boyfriend.

 Julie Myfors had contacted Sedro-Wooley police after she discovered her daughter was dating William Elms, 19, who is a registered sex offender.

 Myfors told police her daughter had met Elms on her biweekly visits to her father's home in Sedro-Wooley. When she discovered the Elms was a convicted sex offender, she told her daughter, but the girl continued to date Elms.

Jury: Terrance Black guilty of murder of Susan Loper

MCKINNEY — Terrance Black has been found guilty of capital murder in the death of Susan Loper. The jury of nine men and three women reached a verdict after nearly four-and-a-half hours of deliberations.

 Loper, 40, was abducted from Gleneagles Country Club on April 19, 2011. Her body was found in a Frisco field the following day.

The verdict came at the end of the nine-day trial, which featured 83 witnesses and hundreds of items of evidence.



NJ Dad Accused of Baby's Bridge Death Testifies

A man accused of throwing his 3-month-old daughter off a New Jersey bridge testified at his murder trial Thursday that the child was already dead when he tossed her into the Raritan River.

Maddie ‘is with German family’

Tourist Frank Bode, 42, said he saw a girl resembling Maddie with a German family. The businessman took a blurry picture of the youngster who he said was British and did not seem to fit in with the family.

 He was so convinced it was Maddie — who vanished in Portugal in 2007 days before her fourth birthday — that he immediately contacted “Find Madeleine” investigators in the UK.

Accused child rapist James Maxwell pled not guilty this morning to charges of first-degree murder in the 2011 strangulation deaths of two Volusia County women, officials said.

According to Duson Police Chief Frank Andrew, Assistant Chief Lt. Gerald Credeur has been removed from the Keiosha Felix case because of substandard performance. He would not elaborate on specific reasons. The department is conducting their own internal investigation to decide how to proceed. Tomorrow, Chief Andrew says he will decide who will be leading the investigation here on out.

Oswego, NY -- Oswego County Sheriff's deputies charged a Mexico man in two rape cases involving girls over two years.

Dilan M. Bond, 19, of County Route 43, building 148, Mexico, was charged with second-degree rape and endangering the welfare of a child in a New Haven case in which he was charged with having sex in June and July with a victim under the age of 15.

Restraining order filed against St. Croix County Sheriff in Schaffhausen case lifted

HUDSON - A temporary restraining order filed against St. Croix County Sheriff John Shilts by public defender John Kucinski in the Aaron Schaffhausen murder case was lifted Tuesday afternoon following an arraignment hearing.

Schaffhausen stood mute, and the court entered pleas of not guilty to three counts of homicide and one count of attempted arson.

The restraining order was filed because the sheriff had a mental health worker make regular visits to Schaffhausen’s cell while he is being held in lieu of $2 million cash bond on three counts of first-degree homicide in the deaths of his three young children July 10 in River Falls.

One day after telling police he couldn't remember what had happened in the family's SUV when his wife and three children were fatally shot, Christopher Vaughn told investigators a different story, according to the videotaped interrogation played today for the jury at his murder trial.

Vaughn said that after he had pulled over the vehicle because wife Kimberly was ill, he got out and walked around the SUV. When he got back in, he said, his wife "had a gun in my face."

The funeral of Winnie Johnson, mother of Moors Murder victim Keith Bennett, is due to take place.

Tormented to the last, the 78-year-old died without fulfilling her lifelong wish to find her son's makeshift grave on Saddleworth Moor and give him a proper Christian burial.

The 12-year-old was abducted and murdered by Ian Brady and Myra Hindley - the only one of their five young victims whose body has never been found. Mrs Johnson had begged and pleaded with the killers for help in locating her son's last resting place but to no avail.

Police release new info in Kortne Stouffer case

Palmyra police have released new information in the case of a 21-year-old Palmyra woman who has been missing for a month.

Borough police Chief Stanley J. Jasinski Jr. said Wednesday that officers were dispatched to Kortne Stouffer's apartment at 810 W. Main St. three times the night before she disappeared; not two as previously reported. The first time police responded was at 9:05 p.m. Saturday, July 28, after they received a complaint about underage drinking at the apartment. Jasinski declined to identify who called police about the underage drinking.

As a result of that first call, police have now charged two men with underage drinking. The citations were filed Wednesday with District Judge Carl Garver's office in Palmyra.

Person of interest arrested in the murder of an Orlando mom

ORANGE COUNTY, Fla. (WOFL FOX 35 ORLANDO) - Volusia County Beach Safety officers on Wednesday morning apprehended a "person of interest" in an Orange County murder. Kristofer Gould, 34, was arrested at the Zelda beach approach in Daytona Beach.

 He was taken into custody on unrelated charges, including overnight camping on the beach, carrying a concealed firearm, and giving law enforcement a false name.

 He had his first appearance before a judge Wednesday afternoon.

The state rested its case in the capital murder trial of Terrance Black on Wednesday morning. The final testimony from the state’s witnesses included Scott Epperson, the leading detective in the Plano Police Department’s investigation. Epperson told the jury that “police work is common sense,” saying “no one pointed toward [Jayson Hayes]” as a suspect during the time of Loper’s disappearance.

The defense has repeatedly argued that police did not adequately pursue other suspects in the investigation, like Hayes, Susan Loper’s boyfriend at the time of her death. Epperson said he did consider Hayes, because police work involves looking “at the men most closely associated with a female victim,” especially in a murder case. He said Hayes gave voluntary fingerprint and saliva samples to investigators. However, after being pressed by the defense, Epperson said Hayes’ home was never searched and he cannot recall if investigators asked Hayes if he owned a gun.

COLUMBIA — A friend has testified that the mother of a missing South Carolina toddler considered giving away or selling her son to alleviate the stress of parenting.

Christian Dickerson testified Wednesday that Zinah Jennings had planned her pregnancy but talked about throwing her son out a window or selling him.

Dickerson also said she saw Jennings kick her son, Amir, when the boy was just over a year old.

A photo of a child murder has been posted on the dating website the killer used in the weeks before he sexually assaulted and murdered an eight-year-old.

Michael Rafferty's image appeared on Plenty of Fish, attached to the profile of 'scoobmike', a 'non-smoker' who 'isn't seeking a relationship or any kind of commitment.'

'Scoobmike' claimed to be a 36-year-old from Sasketchewan in Canada and hoping to meet women between the ages of 18 and 46.

NORTH COUNTY — Another batch of court documents was released Wednesday in the case of slain Marine wife Brittany Killgore, providing more details about the investigation that led to three people being charged with murder.

Louis Ray Perez, 46, Dorothy Grace Marie Maraglino, 37, and Jessica Lynn Lopez, 25, have each pleaded not guilty in connection with Killgore’s death. At some point, all three lived at a house in Fallbrook, where Killgore is believed to have died.

A man described by one of his attorneys as a target of police investigating the homicide of Winchester Star reporter Sarah Libbey Greenhalgh was sent to jail for a few days Wednesday on an unrelated probation violation.

Judge Steven S. Smith of Prince William County General District Court revoked four days of a suspended sentence imposed on John Sheldon Kearns for an offense in 2011. Kearns was sent to the Prince William-Manassas regional jail for four days after Smith's ruling.

A York County mom and her boyfriend are charged with physically abusing the mother's three year old son. 29 year old Victoria Manning, of West York and 33 year old Darren Leber, of Dover were charged on Monday by West York Borough Police.

According to court papers, during an interview on August 19, Manning admitted that she caused an injury to the child's face and bruising on the left side of his back. She confessed that she hit the child harder than she should have. But she said that she did not burn her son's foot. She also attributed other bruises on the child as being cause by her boyfriend, Darren Leber.

GRAND JUNCTION — Fire years after his daughter went missing and nearly six months after her remains were found, Paige Birgfeld's father is growing impatient with authorities who won't let him have his daughter's body.

"This is a human being with a family," Frank Birgfeld said. "Not releasing her remains is small and mean-minded."

Paige Birgfeld, the 34-year-old Grand Junction mother of three who led a double life as an escort, vanished June 30, 2007. Her car was found on fire in a parking lot in Grand Junction the following day.

Death Of Clinton Infant Being Called A Homicide

Maine State Police are now calling the death of an infant in Fairfield last month a homicide. The baby died while in the care of a babysitter.

 On the night of July 7th, paramedics were called to a Fairfield home where 3-month-old Brooklyn Foss-Greenaway was found unresponsive and not breathing. The baby later died at a local hospital. State Police are called in to investigate anytime a child under the age of 3 dies.

 "In this case there was some warning signs that we thought very early on," said Department of Public Safety Spokesman Steve McCausland. "The medical examiners have confirmed that and obviously the case now has been declared a homicide."



Jury to begin deliberations in Plano murder case

McKINNEY — Testimony wrapped up late Wednesday in the trial of the man accused in the deadly beating of Plano Pilates instructor Susan Loper.

A Collin County jury will start deliberating the fate of defendant Terrance Black on Thursday morning. On the same day Black's lawyers started their defense, they ended it, setting the stage for closing arguments and jury selection.

In a taped conversation with Venetta Benjamin, played to a jury this morning, Shamsiddin Abdur-Raheem is heard complaining about the possibility that he might spend 45 years to life in state prison for causing the death of 3-month-old Zara Malani-Lin Abdur-Raheem.

Couple Behind Second Videotaped Sex Slaying Pleads Guilty


 The man who pleaded guilty to the 2006 murder of a woman he raped and tortured — and videotaped — was back in court Tuesday for similar crimes against another woman. On Tuesday, Richard Davis, 48, pleaded guilty to the 2006 murder of Michelle Huff-Ricci, 36. Huff-Ricci’s remains were found in Clay County. She had been sexually assaulted. She, along with Marsha Spicer, were murdered by Davis in 2006. Spicer’s death was caught on tape. She was suffocated during sex in an Independence apartment complex.

Police still searching for Moors murder letter

A letter that may reveal where the final victim of the Moors murders is buried has still not been found almost a month after police were alerted to its possible existence.

Detectives began searching for the sealed document supposedly revealing the location of Keith Bennett’s body after murderer Ian Brady’s mental health advocate claimed she had been given it.

Jackie Powell told the makers of a Channel 4 documentary it was addressed to Keith’s mother to be opened in the event of Brady’s death, and said it may contain “the means to her possibly being able to rest”.

Ms Powell has been arrested on suspicion of preventing the burial of a body and is on bail pending further inquiries.

On July 24, a detention officer was assisting Micheal Spell to a room across the hall from his cell for a haircut. While getting his hair cut, an inmate grabbed the attention of the officer who told him he was not allowed to enter the “pod” with Spell unattended. Roughly 15 minutes later, Thomas David Kilbury, 31, Cuba, Mo., and an inmate yelled that something was wrong with another inmate, and they needed immediate help.

Evidence against Kirkpatrick stands

A judge has denied two motions to suppress evidence in the murder case against Stathis Kirkpatrick in McCook.

On Aug. 10, Judge David Urbom denied two motions to suppress evidence submitted by Kirkpatrick's attorneys in May. Kirkpatrick is accused of killing 14-year-old Kailee Clapp in January 2011. His trial will begin on Sept. 10 in Red Willow County District Court.

Kirkpatrick, 19, of Bartley, is officially charged with first-degree murder, first-degree sexual assault, tampering with physical evidence and unlawful burial in the case. He could face up to life in prison, or possibly death if prosecutors seek the death penalty in the case.

Authorities are still investigating whether Samantha Ellis had any involvement in the death of her 3-year-old daughter last week.

A spokeswoman for Marion County Prosecutor Terry Curry’s office said Tuesday that the case is ongoing .

According to police reports, Samantha Ellis was at the home where her boyfriend Jose Cruz, 20, allegedly beat Carmen until she was covered in bruises and unresponsive. Police found the girl in her mother’s arms when they arrived. Carmen died at the hospital a day later.

COLUMBIA — The South Caro­lina mother on trial in the case of her missing son told police searching for the boy that she needed a break from parenting, according to testimony Tuesday.

Prosecutors played a lengthy interview in which Zinah Jennings told police she was stressed from parenting, criticism from her mother and being unemployed and needed some time to herself. Sgt. Arthur Thomas is heard repeatedly telling Jennings that he understands her situation and just needs to see the boy to know that he’s OK.

“We’ll deal with you still having a break,” Thomas says, also telling Jennings she needs to pray for help. “You don’t have to feel like you’re being forced to take the child back.”

The ex-wife and accomplice of Marc Dutroux, the child murderer whose crimes horrified Belgium in the 1990s, has been freed after serving half her jail term.

Michelle Martin was released after Belgium's highest appeal court dismissed a bid by prosecutors to overturn a lower court's decision last month to approve her early release.

She is expected to move into a convent which has already been daubed with graffiti by angry protesters.

Dutroux was arrested in 1996 and found guilty of kidnapping and raping six girls. He killed two and left two others to starve to death in a makeshift dungeon.

Convicted child-killer seeks day parole

KITCHENER, Ont. – A convicted child-killer who wed another inmate and bore three children while serving a life sentence is once again seeking day parole, two years after having it revoked amid allegations she was mired in shady financial dealings.

Amina Chaudhary, 50, was found guilty of first-degree murder in the 1982 slaying of her ex-lover’s eight-year-old nephew, but has spent the decades since challenging her conviction and the resulting deportation order.

Officials branded Chaudhary a low risk to reoffend for years, citing her exemplary conduct behind bars and the discipline that helped her earn several degrees during her incarceration.

But a 2011 psychological assessment upgraded the risk to moderate, citing a “longstanding tendency to externalize blame” and “difficulties with accepting full responsibility” for her actions, according to documents by the Parole Board of Canada.

Testimony about DNA evidence dominated much of the afternoon of Day 7 of the trial.

Justin Parker, a trace evidence analyst with the Texas Department of Public Safety, testified he was asked to look at several pieces of evidence including a sexual assault evidence kit, a seat belt from the victim’s car, hair samples from the victim’s vehicle, hair samples from Loper’s Pilates studio, hair samples from the defendant’s vehicle, clothes from defendant Black, hair samples from Loper, Loper’s clothing and hair samples found on the victim’s clothing. Parker testified a hair sample found in the side door of Loper’s vehicle is “microscopically similar” to a sample of Black’s hair. He could not say how long the hair had been in the vehicle.
