Probable Cause Found Against Former Teacher

SALEM, N.H. -- Probable cause has been found against a former substitute teacher accused of sending racy messages to a student.

Matthew Levine, 22, was accused of sending inappropriate Facebook messages to a 15-year-old girl he met while substitute teaching at Pelham Memorial School.

On Wednesday, a Salem District Court judge found probable cause against Levine.

Elizabeth Smart kidnapper Brian David Mitchell leaves Utah for federal prison

SALT LAKE CITY — After more than eight years in custody in the state of Utah, jail officials confirmed Wednesday that convicted kidnapper Brian David Mitchell is en route to federal prison.

Salt Lake County Sheriff's Lt. Michael Deniro, a spokesman for the jail, said Mitchell was transferred out of the Salt Lake County Jail by federal marshals Wednesday.

Though Mitchell became known for his courtroom antics, Mitchell apparently didn't cause any problems in jail.

"He has not been a behavioral problem for us during his stay," Deniro said.

He also said Mitchell's tenure in the county facility came at a low cost as "federal prisoners are fully paid for by the federal government."

The father of the Brooklyn boy who was kidnapped and butchered after he got lost leaving day camp wants the accused killer and his father to pay for the horrendous crime -- to the tune of $200 million, the New York Post reports.

Calling the murder of 8-year-old Leibby Kletzky "one of the most horrific crimes in the history of the County of Kings," Nachman Kletzky filed suit seeking $100 million in punitive damages from Levi Aron, who is charged with Leibby's gruesome murder, and the same amount from his dad, Jack Aron, in whose house the boy was allegedly murdered and his body dismembered.

"What's driving the lawsuits is a sense of justice and to compensate the family as best we can," Kletzky's lawyer, Mark Goldsmith, said after filing the two suits in Brooklyn Supreme Court. "The acts are horrific and horrendous, and the level of damages should reflect that."

Shawn Morgan, 43, of Senath, who is accused of killing three-year-old BreeAnn Rodriguez, also of Senath, appeared in a Dunklin County courtroom on Tuesday, August 30, again without an attorney. This is Morgan's second appearance before presiding Judge John C. Spielman. Morgan's previous arraignment hearing was at 9 a.m., Tuesday, Aug. 16 at the Dunklin County Courthouse.

Morgan was escorted into the Dunklin County Courthouse this morning, Tuesday, Aug. 30, by Dunklin County Sheriff Bob Holder and Sheriff's Deputy Wallace Poynor.

Morgan's case was the first on the docket and once again, Judge Spielman read the charges against him which include felony counts of first degree murder, armed criminal action and tampering with physical evidence in connection to the case. During the proceedings, Prosecuting Attorney Stephen P. Sokoloff filed two new charges with the court against Morgan.

Lawyer: Peterson a ‘hostage’ of prosecutors’ court appeals

CHICAGO — Drew Peterson’s attorneys have asked the Illinois State Supreme Court to order the former police officer released from jail where he has been held for more than two years on charges of murdering his third wife, saying prosecutors’ appeal to the same court over hearsay evidence has violated his right to a speedy trial.

“It’s a matter of fundamental fairness,” said the 57-year-old Peterson’s lead attorney Joel Brodsky, who said he mailed the appeal to the court Monday night.

Peterson, a retired Bolingbrook police sergeant, has been in jail since 2009.

His trial in the drowning death of ex-wife Kathleen Savio, originally scheduled to begin in July of last year, has been on hold since prosecutors appealed a judge’s decision to bar them from presenting statements Savio allegedly made about him before her body was discovered in a dry bathtub in 2004.

Hendersonville Police find the woman they say dumped her three-day-old baby in a Bi-Lo trash can. Investigators credit News 13 viewers who saw surveillance video with identifying and helping locate her. The woman's name has not been released and the District Attorney is waiting for autopsy results before filing any charges. Store video shows the woman and a male companion enter the Four Seasons Boulevard Bi-Lo late Sunday afternoon. The woman goes into a restroom holding a large purse. She comes out a few minutes later dressed in different clothing. The woman has been interviewed, she is confirmed as the newborn's mother and police have determined the child was dead when she was brought into the store. The man who was with her is also being questioned in the case.

"Extremely Intoxicated" Woman Arrested While Walking Home With Newborn

Asheville Police arrested a woman who they say was extremely intoxicated while walking home with her eight day old baby.

Lt. Wallace Welch of the Asheville Police Department said that officers responded to a report of an extremely intoxicated woman walking around downtown Asheville with a small child just after midnight Tuesday morning. When they arrived in the vicinity of Pack Square, officers located Sarah Elizabeth Barton, 30, of Asheville, walking toward her home with her newborn baby.

Welch said that Barton was having difficulty walking and maintaining her balance and was visibly staggering with the child. Emergency medical responders were call to check on the child's condition, while Barton provided a breath sample, which registered a .22 blood-alcohol level on a portable "alco-sensor."

Child abuse results in 11-year sentence for mom

An East Side woman was sentenced this morning to 11 years in prison for abuse of her 3-year-old son that included locking him in a linen closet.

Last month, Fairrin J. Moss, 23, pleaded guilty to felonious assault and child endangering. She admitted to striking the boy and to punishing him with stints in the closet for 30 to 45 minutes at a time.

Franklin County Common Pleas Judge Julie M. Lynch sentenced Moss.

Search and rescue teams hunt for new clues to find Nadia Kersh

She disappeared almost three years ago, but the search for new evidence is just heating up. New clues about Nadia Kersh may be surfacing and they're showing up just after a suspect in the case was released.

Dusty is one of several dogs trained to track down evidence. And so far he seems to be doing a pretty good job.

"He gave us an indication that the area we're searching now, which is one of the leads, makes us think we're in the right place," Chris Cantrell, Walker County Search and Rescue said.

Robyn Gardner Met Murder Suspect on Swingers' Site, Friend Claims

Gary Giordano and missing woman Robyn Gardner met online on the web site "Adult Friend Finder," which describes itself as "the world's largest sex and swinger personals community," Gardner's friend told Aruban investigators.

Gardner has been missing since Aug. 2. She was last seen at a restaurant with Giordano, the prime suspect in her disappearance. He is in an Aruban jail, but has not been charged with a crime. A hearing is expected today to determine if there is enough evidence to hold him in jail for another 60 days.

ABC News reviewed witness statements given to Aruban investigators by Gardner's family and friends. A female friend of Gardner told investigators that Giordano, 50, and Gardner, 35, had previously planned a vacation together but Gardner backed out because of Giordano's "scary behavior."

After Eight Months, Investigators Say Hailey Dunn Case Still Priority

COLORADO CITY, Texas -- After eight months since Hailey Dunn's disappearance and after her 14th birthday has passed, some volunteers have questioned law enforcement's commitment in solving the case.

It's been eight months since Hailey went missing from Colorado City.Billie Dunn, the mother of the missing teen, told authorities she was going to a friends house, but she never arrived.

The case caught national attention and for months law enforcement agencies and search volunteers have been on a quest to find Hailey.

Porn in Dunn case not yet presented to grand jury

The case involving the discovery of nearly 109,000 pornographic images on devices seized during the search for missing Colorado City teen Hailey Dunn has not been presented to a grand jury, and law enforcement officials say they're not sure when it will be.

Mitchell County Sheriff Patrick Toombs said Tuesday that J. Bruce Flournoy, a deputy with the Garza County Sheriff's Office, is still analyzing the data, including images of child pornography and bestiality, on the seized devices. Toombs said that during the most recent meeting of the investigation task force, Flournoy did not indicate how much longer his analysis would take.

Man To Face Judge After Wife's Killing

The Seminole County Sheriff's Office released a call Tuesday made by Sarah Rucker, a local mother, who was found stabbed to death in a sub shop's parking lot state Road 434 in Longwood, deputies said.

"I could be dead right now, and you wouldn't even care, and they wouldn't even know," Rucker said in the 911 call she made three hours before she was found dead.

On cruise, father throws son, 7, overboard

SANTA ANA, Calif. - August 30, 2011 (WPVI) -- It was a pleasant afternoon aboard a sightseeing cruise around California's scenic Newport Harbor until the unthinkable happened - a man threw his crying 7-year-old son overboard during an argument in front of shocked passengers, authorities said.

Sloane Briles, 35, was taken into custody for child endangerment and resisting arrest, Orange County sheriff's spokesman Jim Amormino said.

"The father hit him several times and then threatened to throw him overboard if he didn't stop crying," Amormino said. "The crowd on the boat became very angry at the father for hitting the kid and extremely angry when he threw him overboard."

Authorities said Briles appeared to have been drinking. He was released Monday and couldn't immediately be reached at a number listed for him in Irvine.

3 guilty of murder for starving infant who didn't say 'Amen'

The leader of an alleged Baltimore religious cult and two followers have been found guilty of murder for the starvation death of a 1-year-old boy whom they believed was possessed by an "evil spirit" because he did not say "Amen" after lunch one day. The boy's mother had already pleaded guilty and testified against the three last week.

Queen Antoinette, 41; her daughter, Trevia Williams, 22; and Marcus A. Cobbs, 23, were convicted of second-degree murder and first-degree child abuse resulting in death, the Baltimore Sun says. Javon Thompson was 15 or 16 months old when he died in December 2006 or January 2007. They could be sent to prison for up to 60 years when sentenced May 18.

Mother 'bludgeoned daughters 7 and 4 to death with a hatchet after failed pregnancy

A mother of two is being treated in hospital after bludgeoning her young daughters to death with a hatchet before attempting to kill herself, police said today.

Naiyana Patel, 33, is said to have killed her daughters, aged seven and four, then tried to take her own life after a failed pregnancy.

The bloodbath at the family's home in Asheville, North Carolina, was discovered by her husband Lalji Patel, who found his daughters dead and wife injured on Saturday.

Police: Man Flung Son Off Cruise Ship

Police in Southern California have arrested a man accused of throwing his 7-year-old son off a cruise boat during an argument.

Sloan Briles, 35, was arrested Sunday for investigation of child endangerment and resisting arrest, Orange County Sheriff's Department spokesman Jim Amormino told The Associated Press.

Briles, his girlfriend and two sons were on an afternoon cruise around Newport Harbor with 85 other people when Briles began arguing with the girlfriend and his 7-year-old son before throwing the boy overboard, Amormino said.

The parents and sister of missing Indiana University student Lauren Spierer ran a full-page letter today in her campus newspaper, encouraging young people to take steps to protect themselves.

Here is the main part of the letter, posted in the Indiana University Daily Student and writen in the voice of Charlene Spierer:

ARVADA, Colo. (CBS4) – An assistant principal from Arvada High School is under arrest and suspected of sex assault on a student.

Anthony Alvarez, 40, is being held in the Jefferson County Jail on a charge of sexual assault on a child by a person in a position of trust.

An arrest affidavit from the Arvada Police Dept. states that Alvarez’s wife, Stephanie Alvarez, called the Arvada High School principal on Aug. 25 to report that her husband admitted he had an affair with a student.

Money Hearing Slated In Casey Anthony Case

ORLANDO, Fla. -- The Fifth District Court of Appeal has given Judge Belvin Perry the green light to move forward with a hearing to determine how much money Casey Anthony may have to pay back.

Perry will hold the hearing Friday to determine what costs from the investigation can be attributed to the lies Anthony told.

Four different agencies claim that figure is over $500,000.The court of appeal granted Perry a 30-day jurisdiction over the matter. Legal analysts said that is the only way he could proceed with the hearing.

Judge orders doctors to evaluate sanity of man charged with beheading disabled 7-year-old son

THIBODAUX, La. — A judge in Louisiana has appointed two psychiatrists to evaluate whether a man accused of beheading his disabled son is sane enough to help with his defense.

Defense attorney Kerry Cuccia (KOO’-chuh) says the arraignment for 30-year-old Jeremiah Wright has been postponed until Oct. 17, when the judge also will hear the psychiatrists’ testimony.

Cuccia won’t say why he requested the evaluation by psychiatrists or why Lafourche Parish Judge Hugh Larose decided to appoint them. He says he filed three sealed exhibits.

Texas boy punished for wetting bed dies

DALLAS, Aug. 28 (UPI) -- A Texas couple charged in their 10-year-old son's dehydration death withheld water to punish him for wetting his bed, authorities say.

Jonathan James died in late July at the Red Bird home where he was living temporarily with his father and stepmother, Michael Ray James and Tina Alberson, both 42, The Dallas Morning News reported. The couple are in the Dallas County Jail after being charged with causing serious bodily harm to a child.

The newspaper said documents obtained after the couple's arrest reveal the 10-year-old was denied drinking water for five days in July and died after collapsing and hitting his head on the floor.

Doctor accused of stabbing her daughter 100 times over dog's clothes

HACKENSACK, N.J. -- A New Jersey physician is accused of stabbing her 13-year-old adopted daughter with a screwdriver at least 100 times because the girl failed to wash her dog's clothes properly, police and health officials said.

Dr. Sylvia S. Lee of Emerson, an allergist with offices in Wayne and Old Bridge, faces felony charges of aggravated assault and endangering the welfare of a child.

Her license to practice medicine was suspended at an emergency meeting of a committee of the state Board of Medical Examiners.

Search for missing student intensifies as classes resume

BLOOMINGTON - Volunteers gathered in Bloomington Sunday to spread the word about still-missing Indiana University student Lauren Spierer. It's an effort to keep this case in the forefront, the day before students head back to class.

As new faces descend upon IU this semester, a now-very familiar one will greet them.

"She's so much more than that girl on the poster. She's our daughter. We love her dearly. We're not going to walk away. We're going nowhere," said Lauren's mom, Charlene.

In fact, the search for Spierer is being refreshed and renewed in Bloomington. With new posters in hand, volunteers and students hit the pavement to make sure Lauren's picture can't be missed, that her message can't be ignored.

"I mean this could happen to anyone," said IU sophomore Gabi Cohen.

"I would want everyone to help if it was one of my close friends or family, so I think anything we can do to help is just great," added IU sophomore Maddie Kaufman.

"(Students) hear things. They know things. We're hoping that by getting the message out that Lauren's still missing, someone will come forward, give us a piece of information, something they heard. We desperately need it," said Lauren's dad, Robert Spierer.

Friends, family discuss alleged killer /Jori Lirette

If the devil made Jeremiah Wright brutally kill his 7-year-old son, family and friends say they never saw it coming.

“I would have never thought he was capable of doing it,” said Gabby Chatagnier, a longtime friend. “He was not the type. He was a goofy guy.”

Wright, 30, is accused of first-degree murder in the death of his son, Jori Lirette, two weeks ago today. The 7-year-old's head was found in front of Wright's West Seventh Street home in Thibodaux by a passing driver, police said, with the rest of his body in a white trash bag nearby.

Chandler infant suffered 14 broken bones in abuse case

Police arrested a Chandler woman and her boyfriend Tuesday after a four-month-old infant girl in her care was hospitalized with 14 broken bones and a cigarette burn.

Angelica Jimenez, 25, and her 30-year-old boyfriend, Steven Saldana, were arrested on suspicion of committing child abuse. While in Jimenez’s care on Aug. 3 the four-month-old girl stopped breathing and was taken to a local hospital where she was resuscitated.

While at the hospital, medical personnel discovered the girl had sustained multiple bruises, abrasions, a cigarette burn and 14 broken bones.

Teens Accused Of Defacing Stop Sign Before Fatal Crash

PICKAWAY COUNTY, Ohio -- Two teens are facing involuntary manslaughter charges after they allegedly defaced a stop sign before a fatal crash.

The Pickaway County sheriff's office filed charges on 19-year-old Seth R. Stonerock, from Stoutsville, and 18-year-old Derek W. Greenlee, from Circleville, Wednesday.

Arrest warrants were issued on charges of involuntary manslaughter and tampering with a traffic control device.

The charges are connected to a fatal traffic crash on Wednesday, Aug. 17, off state Route 56 and Huber Hitler Road.

An hour before Colorado City's football team took the field in Abilene, a handful of people met to remember the town's most recognized cheerleader.

Across the street from her house, hundreds of stuffed animals on display showed just how long Hailey Dunn has been gone.

A faded plush Christmas tree, bears clutching red Valentine's Day hearts and a doll with "Happy Easter" on its shirt chronicle the months since her disappearance.

Courtney Gutierrez, a member of Hope for Hailey, was one of the organizers at Saturday's balloon release.

A 30-year-old Thibodaux man accused of decapitating his 7-year-old disabled son last week was indicted by a Lafourche grand jury Friday morning.

Jeremiah Wright, 414 W. Seventh St., allegedly confessed to investigators shortly after the head of his son, Jori Lirette, was found on the side of the road by a passing driver, investigators said.

Wright was indicted on a first-degree murder charge. If convicted, he faces mandatory life in prison and is eligible for the death penalty.

Search for Holly Bobo now a full-time job for her family

Parsons, TN -

(WMC-TV) - As the search for missing nursing student Holly Bobo continues, her family is still leading the effort to bring her home.

The search has taken its toll on the Bobo family. Just over four months after Bobo disappeared, her family's lives have been turned upside down.

At the Bobo house, the TV never comes on. Dinner, once spent at the table as a family, now comes as late as midnight because the search takes priority.

"Now all I do is search for my sister," said her brother, Clint Bobo.

Once a social work student at the University of Tennessee Martin, Clint Bobo has now taken up the search for his sister full time. The 25-year-old is the last person known to have seen Holly Bobo as she was being led into the woods on their property by a man in camouflage.

Instead of attending classes, Clint Bobo travels to neighboring towns and states passing out flyers in hopes it leads to a breakthrough.

Police Investigating 11-Year-Old's Pregnancy

MOUNT CLEMENS, Mich. -- The Macomb County Sheriff's Office is investigating whether a 28-year-old man is responsible for impregnating an 11-year-old girl.

Sources close to the investigation told Local 4 the man worked as a contracted janitor at Prevail Academy in Mount Clemens. The girl has since given birth and turned 12 years old.

Sources said the man was voluntarily going to turn himself in to police for questioning.

MOBILE, Ala. (WALA) - Noticeably smaller after spending the last few months behind bars, John DeBlase pleaded not guilty to two counts of capital murder Wednesday.

DeBlase is charged with killing his young children, Natalie and Chase. Their bodies were found dumped in the woods.

Natalie was found in the Citronelle area. Her brother Chase was discovered in Mississippi.

DeBlase's attorney said he is not guilty by reason of insanity.

Baby Gabriel case: Judge denies motions to release mother, remove prosecution

The judge in the case of missing Baby Gabriel on Thursday denied motions that would have removed the Maricopa County Attorney's Office from the case and allowed defendant Elizabeth Johnson to be released on house arrest with a monitor.

The judge set a final hearing on whether Baby Gabriel's mother is competent to stand trial Sept. 16.

Johnson, 25, charged with kidnapping, child abuse, custodial interference and conspiracy to commit custodial interference has been held without bond at Estrella Jail since January 2010.
