Inmate Testifies Against Hataway

SANFORD, Fla. -- The state has rested its case in the James Hataway attempted murder trial.


A black curtain was drawn to protect a man who met Hataway in the Seminole County Jail and testified against him on Thursday.

Thomas Malloy is now a member of the federal witness protection program. He said Hataway bragged about knowing how to break people's necks and testified that Hataway admitted he attacked Rachel Clarke and wanted advice on covering it up.

The defense argued that Malloy is testifying against Hataway to get his sentence reduced. He is in jail for a prison fight that left an inmate dead.

Hataway is accused of trying to kill Clarke after the two left a party together in 2008.

Boyfriend charged with murder of Stout

That’s according to court documents filed today that charge Stout’s boyfriend with murder.

Not only was 30-year old Jorge Huerta Cardenas allegedly driving Stout’s car for a day or two after she disappeared, police say they found blood and hair in the trunk.

“The examination of that car revealed items in the trunk that make it appear that it might have been used to transport the body. Further the body of Miss Stout up in Cass County appeared that it has been dumped there she was not killed there but got transported to the scene and got dumped,” said St. Joseph County Deputy Prosecutor Joel Gabrielse.

Stout was last seen in the early morning hours of March 23rd, and relatives got suspicious when she failed to show later that day for scheduled visitation with her young son.

On Monday March 28th, Stout’s body was found in a rural area of Cass County, Michigan.

Court documents show that Cardenas was first arrested on March 29th for False Informing.

Cardenas had several aliases, and was in this country undocumented.

“We’re very confident that we’re going to be able to prove not only the elements of the offense of murder, but as well, as the jurisdiction of the crime when we go to trail,” said St. Joseph County Prosecutor Michael Dvorak.

Girl Abused On Donated Camera's Photos Sought

PENSACOLA, Fla. -- Pensacola police released images of a home and a day care center in efforts to find a sexually abused girl.

The Panhandle police department released the images Tuesday after searching for the girl for more than three months.

Detectives began looking for her after volunteers at a local thrift store found graphic images on a donated camera of the girl being sexually abused. They say the photographs were likely taken around 2006 somewhere in the southeastern United States. It appears the girl was around 4 years old when the photos of her being abused were taken.

Horman divorce hearing postponed for 3 months

A judge handling the pending divorce case between the father and stepmother of a missing Oregon boy has canceled a hearing this week and will delay it for another three months.

Kaine Horman, the father of missing Kyron Horman, filed for divorce shortly after his son disappeared last June from Skyline School in suburban Portland.

Law enforcement authorities informed him they had learned his wife, Terri Moulton Horman, allegedly tried to solicit a landscaper to kill him about six months before Kyron's disappearance.

The Oregonian reports the same judge ruled last October there was a substantial overlap of evidence in the divorce case and a separate criminal investigation. No suspects have been named and the attorney for Terri Horman has repeatedly declined comment.

No new hearing date has been set.

I had heard the name Casey Anthony before I even worked at In Session.
During those summer months in 2008, the story of missing two-year-old, Caylee Anthony was in the newspapers and on television every night. The 911 call from a frantic grandmother, a grandfather who seemed angry and frustrated with law enforcement, and a mother who just did not appear to be worried or scared. It seemed like something out of a made-for-TV movie, because no one could understand why the mother of a missing little girl stayed silent for 31 days.
I went to Orlando with a field producer, our anchor Vinnie Politan and a camera crew. For me, it was in hopes of understanding this woman who has been so vilified by the tabloids and the public. Because behind every trial there is a story, and there are people who had lives before the trial.
It was an early morning flight to Orlando – Vinnie and I arrived on location to meet the producer and photojournalists who were setting up for the day. Our first stop – the home of George and Cindy Anthony.

n the Case Against Casey, all eyes will continue to focus on the science at this week's Frye Hearing.
Just Wednesday, more transcripts of depositions were filed. One of the four added in the court file is of Dr. Madhavi Martin from the Oak Ridge National Laboratory in Tennessee.
Dr. Martin explained LIBS -- Laser-induced breakdown spectroscopy. She said it's a technique that uses lasers to generate specific elements that are present in the sample.
She describes it as making a fingerprint.
This technique has been around since the 1960s.

Search warrant at Akron home reveals more details about missing woman found dead

ARKON, Ohio - A search warrant filed in Akron Municipal Court revealed more details about the case of Summer Inman, who was found dead in southeast Ohio after missing for more than a week.
Summer was discovered in a septic system off Route 33 in Athens County at about 9 p.m. on Tuesday. She had been missing since March 22.
The search warrant was executed at a home in the 1900 block of Faye Road in Akron. According to the March 23 filing, its purpose was to locate and seize evidence in connection with the kidnapping of Summer Inman. That’s where the Crown Victoria driven by the suspects in the case was seen on March 23.

A suspect in the disappearance of a 25-year-old Ohio mother has led authorities to her body, police said Wednesday.
The mother-in-law of Summer Inman led investigators to the young woman's body, located in a septic system behind a church in Athens County, Ohio, Fox8.com reports.

Mishawaka woman's death ruled homicide

A Mishawaka woman whose body was found in a Cass County field on Monday afternoon was strangled, authorities said Tuesday.
Cass County Medical Examiner Dr. Robert Knox ruled that Kim White-Stout, 38, died of asphyxia ligature strangulation to the neck area. Her death has been ruled a homicide.
White-Stout, of the 200 block of Ardennes Avenue, was reported missing by her family last week. She reportedly disappeared early in the morning on March 22 after spending the evening with friends at Bleachers Pub on Grape Road in Mishawaka, said her niece, Summer White, who filed a missing person's report with the Mishawaka Police Department.
Her body was discovered by an employee from the Cass County Road Commission about 1:30 p.m. Monday in a field on Lane Road south of Davis Lake Street in Jefferson Township, northeast of Edwardsburg near Eagle Lake.
According to the forensic pathologist's report out of Grand Rapids, White-Stout likely had been dead since March 23 or 24, Knox said.

Casey Anthony defense bills the state $103,470

The Casey Anthony defense team has billed the state more than $103,000 for her case in the year since the woman was declared indigent, according to a newly released financial report from the Justice Administrative Commission.

The JAC provided a spreadsheet today showing the defense has billed $103,470.89 as of today. Of that total, the Commission has paid out $60,226.62. An additional $31,596.11 has not been paid yet, while another $11,648.16 in billings "will not be paid," according to the financial report.

So far, the bulk of the defense billings – more than $52,150 – and the state-paid expenses – more than $40,300 – fall under the line item "Personal Services – Independent Contractors." That funding is mostly for investigative work and court-appointed mitigation specialist expenses.

Senate votes to make more child killers subject to death penalty

Those who murder a child up through the age of 10 would face the death penalty in Texas under a bill approved by the Senate Wednesday. The measure by Sen. Joan Huffman, R-Houston, would raise the age of a child - from the current 6 to 10 years old - that would trigger a capital offense under the state's penal code. The legislation, approved on a 28-2 vote, now goes to the House.
Texas currently has the youngest age limit for defining a capitol offense in the murder of a child. Most states classify a child's murder as a capital crime under the age of 12, although Wyoming sets the threshold at age 17. Huffman said her legislation would bring Texas more in line with other states when it comes to determining whether a child killer should be subject to the death penalty.

Kampfer Clarifies Hailey Dunn Statements, Admits Death 'Not Conclusive'

COLORADO CITY, Texas --
City Manager Pete Kampfer on Tuesday told KTXS News – specifically for the first time – that law enforcement officials have reasons to believe that missing Colorado City teen Hailey Dunn is deceased. 
Amid questions and protests from relatives of the missing 13-year-old, Kampfer clarified his statements Wednesday, saying his comments about Hailey being deceased were not intended to be interpreted as “conclusive.” 
He said his statement that officials “have reasons to believe that Hailey is deceased” was meant to convey the same approach law enforcement has had for more than two months: The case is considered a criminal investigation – not a runaway teenager. 
Nevertheless, the wording Kampfer used on Tuesday in statements to KTXS News was the first on-the-record public statement specifically acknowledging that officials believed Hailey was deceased. When asked by a KTXS reporter, he twice repeated the statement that officials “have reasons to believe that Hailey is deceased.”

Coleman Seeks to Bar Handwriting Expert’s Testimony

WATERLOO, IL (KMOX)-Chris Coleman’s attorneys are seeking to ban the testimony of a handwriting analyst, at his upcoming triple-murder trial.
They filed a motion in Monroe County Circuit court this week. It’s expected to be heard at an April 4 hearing, at which time the judge will also hear further arguments on whether to allow a linguistics expert to testify.
Prosecutors are trying to link messages spray painted on the walls of Coleman’s home after his wife and two sons were murdered, to his previous writings.
Jury selection is scheduled to begin April 25.
