The state must return the two children they took away from the estranged ex-fiancé of “People’s Court” mom Michelle Parker - even though cops call him the sole suspect in her disappearance.
An Orlando judge ruled at an emergency hearing Wednesday that the state had no right to take custody of the 3-year-old twins, and ordered them returned to Dale Smith.
The Department of Children and Families took the twin tots on Tuesday, one day after cops announced they were investigating Smith.
At the Wednesday hearing, a state representative argued that the children weren’t safe with Smith because he had a history of abusing women, the Orlando Sentinel reported.
But the judge shot the argument down.
Meanwhile, search crews, including a dive team and a K-9 unit, gathered at an Orange County area lake on Wednesday morning to resume the search for the young mother.
